Vivecorp Privacy Policy

At Vivecorp, we respect concerns about privacy and safeguarding personal information. This policy is intended to help users of Vivecorp services understand how Vivecorp gathers and uses information, as well as the precautions Vivecorp takes to handle the information users provide in a safe and responsible manner. This policy does not apply to personal information collected from you in other ways, or through websites or other electronic or digital means that Vivecorp does not own or control. Vivecorp reserves the right to change this Privacy Policy as appropriate. Please review this policy on an ongoing basis to keep informed about present Privacy Policy practices.

PRIVACY POLICY SCOPE                                                                                                                                                                                 

This Privacy Policy applies to information we collect through electronic or digital means including our website, our mobile website, and mobile applications, or other electronic and digital means of communications (collectively referred within this Policy as our “Digital Properties”) as well as other personal information voluntarily collected and maintained by Vivecorp as it applies to participation in our programs and services. Unless disclosed otherwise, our affiliated sites are governed by this Privacy Policy.


THE INFORMATION Vivecorp COLLECTS
Vivecorp collects information directly from the user (such as name, e-mail address and contact numbers) only when the user voluntarily accesses our Digital Properties and enters the information voluntarily and in connection with user requests for information. Vivecorp also may collect information following a promotional campaign or if a membership is purchased.

Vivecorp may also collection information by asking a user to fill out a PAR-Q (Physical Activity Readiness Questionnaire) prior to joining a Vivecorp-managed fitness facility or participating in a Vivecorp fitness service. The Physical Activity Readiness Questionnaire is designed to determine an individual’s safety when starting a new exercise plan.

HOW Vivecorp USES THE INFORMATION USERS PROVIDE
Vivecorp may use the information voluntarily provided to communicate promotions, newsletters, updates, special programs and information about Vivecorp through e-mails, social media, mailings using the post office and possibly telephone contacts. If you do not wish to be contacted by Vivecorp, you have the option to opt-out by requesting that you not be contacted. Click the unsubscribe link on the bottom of any e-mail communication you receive from us to be removed from the list. Vivecorp also may use your information generally to evaluate the effectiveness of our website services and digital communications as part of overall demographic data and statistics.

Vivecorp uses the information collected through a PAR-Q to determine any medical conditions or physical inabilities a client may need to speak to their GP about and the fitness specialist may need to take into consideration during training.

We do not sell, trade or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety.

PROTECTIONS FROM DISCLOSURE OF MEDICAL INFORMATION                                                                                                         

We are required by law to maintain the privacy and security of your personally identifiable health information. Although the fitness and/or wellness program and your employer may use aggregate information it collects to design a program based on identified health risks in the workplace, Vivecorp will never disclose any of your personal information either publicly or to the employer, except as necessary to respond to a request from you for a reasonable accommodation needed to participate in the fitness and/or wellness program, or as expressly permitted by law. Medical information that personally identifies you that is provided in connection with the fitness and/or wellness program will not be provided to your supervisors or managers and may never be used to make decisions regarding your employment. Your health information will not be sold, exchanged, transferred, or otherwise disclosed except to the extent permitted by law to carry out specific activities related to the wellness program, and you will not be asked or required to waive the confidentiality of your health information as a condition of participating in the fitness and/or wellness program or receiving an incentive. Anyone who receives your information for purposes of providing you services as part of the fitness and/or wellness program will abide by the same confidentiality requirements. The only individual(s) who will receive your personally identifiable health information is (are) certified fitness specialists and health coaches in order to provide you with services under the fitness and/or wellness program. In addition, all medical information obtained through the fitness and/or wellness program will be maintained separate from your personnel records, information stored electronically will be encrypted, and no information you provide as part of the fitness and/or wellness program will be used in making any employment decision. Appropriate precautions will be taken to avoid any data breach, and in the event a data breach occurs involving information you provide in connection with the fitness and/or wellness program, we will notify you immediately. You may not be discriminated against in employment because of the medical information you provide as part of participating in the fitness and/or wellness program, nor may you be subjected to retaliation if you choose not to participate. HOW COOKIES ARE USED
A “Cookie” is text information stored on your computer’s hard drive by an internet web server. When you visit or use Vivecorp’s Digital Properties, Cookies automatically store certain information related to your internet use. The Cookies Vivecorp uses help Vivecorp improve and streamline your use of our Digital Properties each time you return. If you want to avoid the use of Cookies, you will need to personally reconfigure your computer to do so. This is not something Vivecorp can do at its end.

YOUR PERSONAL ACCOUNT
You may be required to set up a personal account to access features within Vivecorp’s Digital Properties. This may require that you create a username and password. You also may be required, as part of the account creation process, to share personally identifiable information as discussed above and herein. Vivecorp strongly encourages you not to share your username or password with others to help safeguard your account and information. Vivecorp staff will not ask you for your username or password in connection with any general communication to you. If you experience any problems accessing and using any of our Digital Properties, please contact Vivecorp’s Center Director, who will help solve your problem or who will put you in touch with someone else affiliated with Vivecorp to help you.

USE BY Vivecorp AFFILIATES
Vivecorp is part of a group of fitness and wellness centers that share a centralized corporate management, operations and support team. That team of people provides services to Vivecorp and helps Vivecorp operate more efficiently and effectively. The services the team may provide include marketing, maintaining and updating the Digital Properties, sending e-mail and mail through the post office, collecting and analyzing data, preparing statistics, and enhancing user and/or member service. A corporate team member may have access to the personal information you provide to enable him or her to perform these necessary tasks and further to better serve Vivecorp members and Digital Property users.

LEGAL CONSIDERATIONS
Vivecorp reserves the right to disclose the information you provide if Vivecorp reasonably believes disclosure is necessary to comply with a court order, a subpoena, a judicial proceeding, public health obligations or as may be required through any valid legal process.

By accessing our Digital Properties, you agree to assume any risk of use and you assume full responsibility for any potential problems that may arise to your personal property or information following that use. You acknowledge that Vivecorp and all of its affiliates shall not be liable for any damages relating to your use of this site.

CHANGES TO Vivecorp PRIVACY POLICY
If we decide to change our Privacy Policy, we will post those changes to the Privacy Policy on our homepage, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on our Digital Properties. Your use of the Digital Properties following these changes means that you accept the revised Privacy Policy.
